By participating in the draw, participants acknowledge and fully accept these rules. Anybody who does not accept these rules should not participate in this draw. Infringement of one or more of the articles contained herein will deny the individual the opportunity to participate in the Draw and any prize won.
ARTICLE 1 - HOSTING COMPANY
The company EVIDENS DE BEAUTE, a simplified joint-stock company with a capital of 8,640€, registered at the RCS in Paris under the N° 484 898 051, SIRET N° 48489805100012, of which the registered office is located 26 rue Galilée, 75116 Paris, France, represented by its founder, Mr. Charles Edouard Barthes, is organising a prize draw entitled “Garapon 15 ans” under the conditions defined in these rules.
ARTICLE 2 – DESCRIPTION
The prize draw, entitled “Garapon-15 ans” will take place from 01/03/23 to 31/07/23. Entry into the prize draw is available to any natural person of a legal age. The draw will be available in French, English, Spanish, Chinese, Japanese and Russian. The draw can be accessed through a computer, tablet or smartphone, via a site hosted on the EviDenS de Beauté Internet site. This free draw will award the client a prize which is attached to an obligatory purchase. The draw is part of celebrations marking the brand's 15-year birthday.
ARTICLE 3 - CONDITIONS OF PARTICIPATION
3.1 Participation in the Draw is open to anyone except staff members of the Draw's Hosting Company, companies who have participated in its promotion and/or implementation as well as family members (partners, ascendants, descendants, brothers and sisters) who have received information about the prize draw through any communication method.
3.2 In order that all players have the opportunity to win, participation in the draw requires good faith, meaning the rules and other players' rights must be fully respected. The Hosting Company reserves the right to legally pursue, by any means, any attempt to violate these rules, particularly regarding the communication of misleading information or fraud attempts.
3.3 One entry per person (with the same name and email address) is permitted.
ARTICLE 4 - DRAW PRINCIPLE AND METHOD
4.1 Draw entry is available on the following dates: 14/03/22, 15/03/22, 16/03/22, 14/04/22, 15/04/22, 16/04/22, 14/05/22, 15/05/22, 16/05/22, 14/06/22, 15/06/22, 16/06/22, 14/07/22, 15/07/22, and 16/07/22.
4.2 To participate in the draw, each player must fill in the registration form fully and accurately (obligatory fields: Name, First name, valid email address, and Country). Any information that is filled out incompletely, incorrectly or illegibly, whether intentionally or unintentionally, or completed in a way other than that described in these Rules, will be considered void. Once the form has been duly completed, the player must click "validate".
Clicking on “validate” will generate an automatic entry into the draw.
ARTICLE 5 - RESULTS
5.1 Winners will be chosen automatically through the online prize draw. The prize draw prizes are available for consultation in article 6.
5.2 Winners will be informed via email only, on the day they took part in the prize draw, via the e-mail address they have provided on the registration form. Each winner will each receive a unique code to be redeemed once via e-mail on the EviDenS de Beauté e-commerce site https://evidensdebeaute.com/ which will give the winner the right to a gift in his or her next order. The gift will depend on the prize awarded in the draw. If the winner selected from the prize draw fails to use the code to receive their gift, the prize is lost and will not be replaced.
To receive the prize, the winner must use his or her unique and personal code on the e-commerce site https://evidensdebeaute.com/ when he or she purchases at least 1 product.
Unsuccessful entrants will not receive an email.
5.3 The winner authorises the Hosting Company to carry out all the necessary checks regarding his or her identity and telephone number. It is expressly agreed that data held within the Hosting Company's information systems or by its technical service providers is accepted as legal evidence with regard to determining winners.
5.4 By reason only of the acceptance of his or her prize, the winner authorizes the Host Company to use his or her surname, first name, town and area of residence in any promotional event, on the Hosting Company's Internet site, on any affiliate site or in any communication from any affiliate service provider, without this use granting any right or remuneration other than the prize won, for twelve months after the Draw's end date.
ARTICLE 6 - ALLOCATION AND DELIVERY
6.1 Once their eligibility is confirmed, winners chosen via the prize draw will be randomly allocated one of the following EviDenS de Beauté prizes via a prize draw (subject to stocks) : The New Born Eyes Mask with a unit value of 30€ including all taxes, The 7 Minute Moisture Lift mask with a unit value of 45€ including all taxes, or 30ml The Serum with a unit value of 295€ including all taxes.
6.2 Prizes will be issued in the form of an email code to be applied on the https://evidensdebeaute.com/ e-commerce site when winners buy a product.
6.3 The prize cannot be exchanged, returned or redeemed for any financial compensation and is not worth any cash equivalent. No alternative can be requested from the Hosting Company for any reason whatsoever. Any potential complaint regarding prize availability will not result in any financial reward and/or cash equivalent.
6.4 While the Hosting Company reserves the right to replace the prize with one or more prizes of an equivalent value, there shall be no complaints made relating to this.
6.5 In no case shall the Hosting Company be held responsible for delays in the availability of the prize or for the winner being unable to receive the prize because of circumstances beyond the Hosting Company's control. The terms of withdrawal will be specified to the winner via email.
6.6 The Hosting Company accepts no responsibility for any event or damage of any kind that may occur as a result of the winner's enjoyment and/or use of the prize awarded, and the winner expressly acknowledges this.
ARTICLE 7 – FILING OF THE RULES
These rules are filed with Bailiffs SAS ACTANORD, domiciled at 105 Quai des Chevillards in Lille (59000), France. These rules are available in their entirety and for no charge on the website https://evidensdebeaute.com/. A copy of the rules will be sent free of charge to anyone who requests them, by post only, from the following address throughout the duration of the Draw: EviDenS de Beauté - 26 rue Galilée, 75116 Paris, France. Postage costs used to complete the request will be refunded at the current second-class postage rate on written request.
ARTICLE 9 - PERSONAL DATA
9.1 It should be noted that to in order to take part in the Draw, players are obliged to provide certain personal information (name, first name, address email, country). This information is recorded and stored electronically and is necessary for the purposes of participation, determining winners, and awarding and delivering prizes. This information is intended for use by the Hosting Company, and may be passed to technical service providers and contractors responsible for delivering prizes.
9.2 Subject to their explicit permission or, in some cases, failing objection on their part, the Host may use information collected about participants in order to better serve them and inform them about new products and offers likely to interest them.
9.3 Pursuant to the French law n° 78-17 of January 6 1978 relating to personal privacy protection, entrants have the right to access, rectify and delete data relating to them, exercisable on written request at following address (postage refunded at the current second-class postage rate), within 7 days of the end of the Draw: EviDenS de Beauté – 26 rue Galilé, 75016 Paris, France.
ARTICLE 10 – RESERVATIONS
10.1 The Host Company reserves the right to amend these rules at any time and to make any decision it may deem useful for the application and interpretation of the rules. The Host Company use any method it chooses to communicate any such amendments or decisions to entrants.
10.2 In addition, the Host Company reserves the right to modify, extend, reduce, suspend or cancel the Draw without notice, owing to any event beyond its control and in particular in the case of an event constituting force majeure or unforeseeable circumstances.
10.3 In particular, the Host Company shall reserve the right, if necessary, to invalidate and/or cancel the Draw in part or in full, if it appears that any fraud or malfunction of any type whatsoever has occurred regarding participation in the Draw or determining the winner. On this assumption, it reserves the right to withdraw the awarding of the prize to the fraudsters and/or to bring before the competent courts the parties who have committed such frauds. The fraud shall entail the immediate disqualification of the fraudster.
10.4 The Hosting Company cannot be held liable for the above and therefore entrants shall not be entitled to any damages or compensation of any nature.
ARTICLE 11 - APPLICABLE LAW AND DISPUTES
11.1 These rules are subject to French law.
11.2 In order to be considered, any potential dispute relating to the Draw must be made by written request within ninety days of the closing date of the Draw as laid out in these rules, at the following address: EviDenS de Beauté – 26 rue Galilé, 75016 Paris, France.
11.3 In the event of persistent disagreement about the application or interpretation of these rules, and in the absence of an amicable agreement, any litigation or dispute will be subjected to the exclusive competence of the Caen Courts.
